This is the deal for your website build and monthly care plan. It goes with a packages sheet that has your prices on it.

Who you're dealing with

BuiltByTyler LLC, a California LLC in Monterey. When I say "I" below, that means the company. I'm Tyler Wade. I own it, I do the work, I sign for it.

What you pay

A one-off build fee, then a monthly care plan. The build fee covers making the site and publishing it properly including setting up the DNS and a Google search engine optimization so more people discover your business. The monthly covers hosting, patching, backups, and any changes you want made. Prices are on your packages sheet.

  • The build fee and your first month are charged the day you start. The monthly begins a month later.
  • Stripe takes the payment on their own page. Your card details never touch anything of mine. Your statement reads BUILTBYTYLER.
  • No minimum term, no cancellation fee. The monthly renews until you stop it.
  • If a card fails, Stripe quietly retries for a few days and nothing switches off while that runs. You'll only hear from me if it keeps failing.

Cancelling

Email me at twade@builtbytyler.com and say you want to stop. No form, no phone call, no fee, no notice period. I'll confirm within one working day, and that reply is your receipt. Your site stays up through the month you've paid for. No partial refunds, nothing further charged.

What you own

  • Your site. Your words, your photos, your logo, and the pages as I built them. I can make any changes requested, and you can be as specific as you want with them. "Use these pictures, change the colors, and restructure" are some of the most common requests. I can even work from sketches if you would prefer that way.
  • My framework. You get a permanent, worldwide, free licence you can't lose: use it, host it, change it, hire anyone you like to change it, as part of your site, for as long as you want. It survives you leaving and transfers if you sell the business. The one thing you can't do is pull the framework out and sell it or build other people's sites with it. That's the only thing I hold back, and it's why I can build yours in days instead of months at this price.
  • Your content. Photos, words, reviews, customer enquiries. All yours.

How fast I move

  • Changes. On a preview link, usually by the end of the day or first thing next morning. Live once you say yes.
  • Site down. I'm on it right away.
  • Anything else broken (a form not arriving, a dead link, something looking off): same day.

What I need from you

  • Accurate details. Hours, phone, address, services. I write from what you and your reviews say, and I won't put a claim on the site you can't back up.
  • Your CSLB licence number, if you're a licensed trade in California. It has to be on the site. That's state law, not my preference, and I won't put a trade site live without it. I check it before go-live and again each month while I host you. If it lapses or gets suspended, tell me the same day and I'll pull the number and the trade claims off the page until it's back. Advertising contracting work without a current licence is a crime in California, and I'd rather your page went quiet for a week than either of us got cited.
  • Photos and a logo, or the site keeps using placeholders and says so.

What I promise, and what I don't

I don't promise the site will never go down, that a host or a third-party tool will keep working, that Google will rank you anywhere, or that the site will bring you any particular number of calls.

Other than what's written here there are no other warranties, express or implied, including the implied warranties of merchantability and fitness for a particular purpose. Plainly: what I've promised you is on this page, and nothing is silently promised on top of it.

If something goes wrong

If something I build or host costs you money, what I owe back is capped at the greater of your build fee or what you've paid me in the twelve months before it happened. I don't cover lost profit, lost business, or a job you didn't win. Nobody can put an honest number on those, and if I had to carry them this would cost you a great deal more than $50 a month. What I carry instead is the work: if it's broken I fix it, and I fix it first.

Two things sit outside that cap and always will: anything I do deliberately or dishonestly, and anything the law won't let me limit.

Content, and who carries what

What you give me stays yours and you can use it anywhere. You're responsible for the accuracy of what you tell me about your business. I'm responsible for the site working, for what I build, and for not inventing anything about you.

When you send me a photo, a logo or words, you're telling me two things: they're yours to give, and I can publish them on your site while the site is up. If something turns out to belong to a photographer, a supplier or a former employee who never agreed, that's the one thing on the site I can't check for you, and it lands on you. Not sure who took a photo? Tell me and I'll leave it out.

Reviews go up as the customer wrote them. I don't reword them and I don't write new ones.

If someone sues. Over something you gave me to publish (a photo you didn't own, a logo, a badge, a claim about your work, a licence number, a review), that one is yours: you cover it, including what it costs me to defend it, and I hand over everything I have on file. Over something I wrote or built without you (the code, the design, words I drafted), that one is mine, on the same terms. Either way, tell the other one within a week, and neither of us settles in the other's name without asking first.

Your customers' details

Enquiries from your forms go to you. They're yours, not mine.

I can see them in passing because I run the site. I use them for one thing: making your site work and fixing it when it doesn't. I don't sell them, don't add anyone to a list, and don't keep my own copy beyond what the site needs to get the message to you. I hold them to the same standard California law would hold you to if you held them yourself.

Ask me any time what I hold, where it is and who else touches it, and I'll tell you within a week. Want it deleted? Say so and it goes. If anything changes that stops me meeting this, I'll tell you before it affects your data, not after.

Your Google Business Profile

You add me as a Manager. Never an owner, never with your password. I use it to keep the profile matching the site and to pull the numbers for your monthly report. I don't change anything without telling you first. I take myself off the day you leave, and you can remove me in one click any time without anything on your site breaking. Everything in the section above applies to whatever I can see there.

If something happens to me

I'm one person, so this is a fair thing to ask.

  • You have the code from day one. It's in your inbox at go-live, not on request.
  • Your domain is registered in your name. I pay for it out of the monthly and keep auto-renew on, and the transfer code is yours the day you ask, so owning it does not depend on me being here.
  • If I die, sell up or can't work, whoever takes over is bound by this page exactly as I am. Don't want to deal with them? Leave that month, no notice, no fee. I can hand this agreement to a successor, but not to anyone who won't sign up to these terms.
  • Hosting. Your site runs in accounts in my name. If I'm not here, the copy in your inbox plus the domain in your name are what put you back up. Any competent developer can do it.

Agreed

Signing means you have read this page and the packages sheet and you agree to both. Paying the first invoice does the same thing.
